The U.S. Department of the Treasury and the Internal Revenue Service (IRS) have jointly issued a final rule regarding the implementation of the Section 48 Investment Tax Credit (ITC) in the U.S. renewable energy sector.
The ITC allows investors to receive a tax credit of about 30 percent of the cost of the renewable energy project they invest in. The rules are largely in line with proposed rules issued in November 2023 that incentivize more clean energy investment through tax incentives to diversify and sustain the energy mix. Lawmakers expect the new law to take effect in the near future, when the Treasury Department's latest rule document is published in the Federal Register.
The final rules are detailed on several aspects, including inverters, grid connectivity and energy storage, which are particularly relevant to the solar industry. With respect to inverters, the Treasury Department and the IRS clarified the definition of a solar system to include all solar modules connected to the same inverter or connected to the same electrical load, which will be considered as one item when calculating the tax credit provided by the ITC.
In terms of grid connectivity, regarding eligibility for tax credits for community solar projects, Treasury and the IRS clarified that the costs paid or borne by taxpayers for qualifying connected equipment are already included in the calculation of ITC eligibility.
This ruling has important implications for ensuring that grid connection investments in community solar projects are eligible for tax credits.
